I remain curious whether the defense will acknowledge the misdemeanor wrongdoing, but dig in against the additional mens rea element that elevates the misdemeanor to a felony. Acknowledging wrongdoing, yet telling the jury that the prosecution is over reaching (over charging), often hits home with jurors.
That strategy would make it highly unlikely that the defendant would testify.
