The JCPOA could not have garnered 2/3 of the Senate. Not matter what it said. So it was done by executive agreement, which carries (legally) the same weight.
BUT: Trump could have (and would have) canceled a treaty just as easily as he did the executive agreement.
So this is a non-issue.
