It is noteworthy that Frank spent two years (of his 25 year career) investigating agent shootings, none of which were deemed an unlawful use of deadly force.
He emphasizes that an agents must subjectively believe he is “imminent danger” of bodily harm or death.
Frank also noted that an agent may have unnecessarily placed himself in jeopardy, but thereafter was justified using deadly force. Both things can be true, and are often the conclusion of investigations involving agent shootings.
Like me, Frank’s initial takeaway when he watched the first video is that this was a bad shooting.
The video clips available to the public have reinforced his opinion that agent was NOT justified to use deadly force. Forensic experts who have examined the footage agree.
Frank notes the abruptness in which the silver ICE pickup truck pulled up to the Honda Pilot, whereby one agent briskly walks up to driver side window. Meanwhile, shooter who had his cell phone out while engaging with Ms. Good’s wife, was initially in front left of the Honda Pilot, which reversed, and then went forward, turning right, in opposite direction of shooter who was moving towards driver side.
It is a lie to characterize Good as “gunning” her Honda Pilot in an effort to run over the agent. [Note the same posters (Baron et al) who were so dishonest about what transpired on January 6th are the same posters who are dishonest about what transpired in Minneapolis]
The bottom line is that regardless of the lies perpetrated by the Trump Administration and parroted on this Board by the cult, the agent was never in imminent danger.
And of course, all three shots fired must be justified.
