The Executive Order maintains birthright citizenship for the children of green-card holders while excluding those whose parents are in the U.S. illegally or on nonresident visas, the Government case hinges on that “subject to the jurisdiction” meant “not owing allegiance to anybody else,” whether to an Indian tribe or a foreign power. So if they are not a legal citizen they fall under the government of where they are a citizen.
