This rule allow congress to repeal any regulation put forth by an agency as long as both house and senate agree to negate the regulation within 60 legislative days of being notified of the regulation. it also must be signed off by the president or be able to override a presidential veto with a 2/3's majority on both houses of congress. There are also measures that can be used to prevent any filibuster.
Paul Ryan explained today that by designed plan, the GOP has been using the first 2 months to eliminate as many regulations as possible while the time line is available.
What is really a key point, and has not been reported significantly, is that the clock for repealing the regulation does not officially start until an official notice is presented to congress about the regulation by the particular agency. And guess what the Obama administration never bothered to do over the last 8 years? Well, they never filed those notifications.
Thus, the GOP can (and at present are) hurriedly go through all of the regulations for the last 8 years, and repeal any of them that they want to do.
I heard the author of the 1996 law interviewed on the radio last month, and she said that the law is very clear in it's requirements, and she was shocked that the Obama admin had overlooked these important notifications. I suspect that they never bothered because they never conceived of a scenario where the GOP would be able to meet the steep criteria to use the law.
Paul Ryan today explained in an interview with Sean Hannity that the reason that they were holding off on Obamacare is because the GOP controlled House and Senate needed to spend the entire 60 day time frame to maximize the successful elimination of the many thousands of regulations that came under the Obama administration.
Ryan also announced that after this is done, an Obamacare replacement bill would be introduced in March 2017.
So there is the answer to the libs here who have asked "where is the repeal and replace"?
