The Nixon case recognized and limited it.
For deliberative process privilege (what’s at issue here), my view is for the executive to avoid Article 1 oversight, it has to assert some compelling national security or other interest. I don’t see one in this instance. If not, it can’t be used simply to avoid that oversight, I.e., stonewalling.
