Better questions are why was he off watch altogether and why was in a cell with the means to kill himself after a prior attempt?
These unfortunately are not uncommon situations involving some level of negligence. I have even conceded negligence in at least one case, but still argued the facility conduct didn’t rise to the level of deliberate indifference which is the liability standard. Likely finding of some negligence here. Wouldn’t want to be the leadership staff at that facility. Very much doubt it was an intentional thing by prison officials or staff, but we shall see.
