…. there is no First Amendment in play, unless and until there is Government interference. A company banning someone (e.g. Trump) from their platform is not a violation of one’s First Amendment rights because there is no Government interference. No different than refusing to bake a cake for a gay wedding couple.
If Musk’s idea is to simply allow folks to further amplify their brand via non-stop information or disinformation, then that is his business model. It does not make the “town hall” conversation any more substantive or healthy. Social media is not my cup of tea. My only observation is that social media has negatively impacted the objectivity and judgment of many posters here.
In contrast, when federal, state, and local governments take legislative or executive action which infringes upon free speech, then yes, the First Amendment is in play. Imagine being a school librarian who must send a list of every book in her library to a state commission who reviews the list, and then bans or burns whatever books the commission decides are inappropriate. Welcome to the GOP’s America!
