haven't seen any passage in the constitution that mentions "unenumerated rights" either. you know, something like, "and other rights that are too many and/or complex to mention here in the constitution. these rights we shall call 'unenumerated' so that anyone can do anything they want any time they want and call it 'their unenumerated right'."
most "unenumerated rights" (as you call them) are really privileges. things and acts that people do claiming it is their "right" to do so. it's an intentional perversion of the definition to legitimize somebody's batshit crazy fetish.
"unenumerated rights" would be a blank check for perfidy and anarchy.
