The longstanding DOJ Policy (the one Comey ignored on the eve of 2016 election) is to avoid any appearance of impacting an election via the TIMING of charging decisions re candidates or commenting on an ongoing investigation. That is different than the decision to charge or not charge a candidate. Garland is simply reinforcing the policy of keeping DOJ far and apart from "politics" in the spirit of maintaining impartiality.
