I disagree...

I think this sets up an easy out for the committee. If BYU loses, the committee has no need to hold their spot, so then Miami and ND are side by side and they can just say they are basically even, so H2H is the tiebreaker, and Miami is 10. If BYU wins, it pushes ND and Miami out, and they can absolve themselves of a decision.
