Because Wednesday’s criminal wrongdoing is so unprecedented and represents such a shameful blow to the nation, the guidelines will be thrown out the window. Deterrence will be the #1 factor for convicted defendants in these cases. No one gets probation.
I will assume no prior record for all defendants.
A) The Followers: 12 - 30 months
These are the people who followed the surge inside, walked around with their cell phones like they were in a Las Vegas casino or Walmart for the first time, but did not engage in any violence, did not steal anything, did not vandalize anything, but just committed trespass — wrong building, wrong day.
B) The Followers + Bad Act once inside: 4-7 years
Same as above, but once inside, took property, desecrated property, entered someone’s office, sat at the dias, or took it one level above trespass.
C) Front of the Surge but no violence: 7-10 years
These are the ones who led the charge, physically breaking windows or disregarding orders of the Capitol Police, to breach the building.
D) Physically Pushing Past Police: 8-12 years
E) Physical Violence against Police: 14 — 20 years
F) Killing officer with Fire Extinguisher: Life
G) Lead Conspirators who organized/incited the Insurgents: 30 years — Life.
This group includes anyone who were not physically present.
H) Capitol Police who Conspired with the Insurgents: Life
