Is it a false accusation if a conversation or communication never took place? According to reports the "witness," never spoke to Trump. And finally, can the elements of the offense be proved beyond a reasonable doubt?

a referral to the DOJ...we'll see what happens...to me the DOJ already has compelling evidence that Trump knew there was insufficient fraud to have any effect on the outcome of the election, yet he continued to spread a lie that there was and then fraudulently incited a mob of people he knew were armed, to storm the Capital for the sole reason of illegals stopping the transfer of power.
IMO the DOJ will indict Trump for sedition...to not do so would invite other coup attempts...and once successful, our American democracy would be gone.

Trump's team produce evidence that he won the election...the hearings have been able to present testimony under oath that his AG, WH Counsels and Campaign Manager told him in no uncertain terms that he lost...in Mid-December...upon learning this he "Invited" thousands to come to D.C. on exactly the last day of the electoral process....for what purpose?...to hold a peaceful rally and show support for Trump?...doesn't look like to me...what's your take?
The Jan. 6th Committee has done an excellent job of showing Trump's "Criminal Intent"...he knew he lost, but tried to stop the peaceful transfer of power...which would end the democracy you fought for...are you "OK" with that?
