Have not read the bill. But, this seems to be an “all or nothing” constitutional issue.
I assume if passed, it’s constitutionality will be challenged in federal courts and will be heard by the Supreme Court. But, if SOGI folks are deemed a “protected class,” then they are afforded all the protections of the Civil Rights Act and Fair Housing Act. If not a “protected class,” then Ms Kao’s concerns are academic.
Like “gay marriage,” I predict Americans’ misapprehensions and insensitivity will dissipate rather quickly.
That’s what the bill seeks to do.
I think Biden has a chance to do some really good things on topics like immigration, health care, COVID. He may be the right guy for the right time. Quiet, competent, and moderate seems good right now.
This culture war shit could ruin him though if he isn’t careful.
Biden fully understands the political priorities. He won’t waste energy on anything that distracts from his core priorities.
For instance, he will put on a “sad face” on today’s Senate Parliamentarian’s ruling removing minimum wage from COVID relief bill, but privately knows the COVID bill was rescued today.
SCOTUS in its last pronouncement before the new lineup, suggested that this included sexual orientation.
If that gets codified, will be hard to overturn. Of course the bill will never survive a filibuster, so it’s just a diversion from Joe needing to do some big things.
