If he loses the appeal process, not so smart on their part.
Shouldn't they instead take the case to a Federal Court? If they lose there, they can appeal to a higher Fed Court.

Two types of cases can be tried in a Federal Court
1.) Federal question: Trump was charged with a state crime, not a federal crime
2.) Diversity of citizenship: When the parties are from different states, even violations of state laws can be tried in federal court. Most frequently applied in civil cases and not criminal ones.
However, even decisions from the highest court in a state can be appealed to the Supreme Court.
