He knows he's getting a pardon & D's don't want trial consuming narrative over next month. He is
requesting the right to appeal later (what is there to appeal, I couldn't imagine). But he will use this loophole to get it out of the news and still allow him to claim that he always maintained his innocence when he gets his pardon from his business partner, The Big Guy.
