Keep track of the numbers as this plays out...we could have done all this with the bipartisan Immigration and Border Protection Bill a year ago...that Trump killed in order to keep MAGAs all riled up...and voting for him.

1. One way to avoid eVerify is to keep your payroll under the minimum reporting requirements. In Tennessee, for example, there is no reporting requirement for companies with less than 35 employees. Then, payroll has to be handled in-house -- the payroll processors will require I-9s, and if they don't check out, they will flag them. Typically undocumented employees will provide fake credentials, including fake SSNs. Wages are withheld and credited to the actual owner of the SSN, who more often than not does not catch it. The employer, however, almost always is aware and turns a blind eye to the process, because the employer needs the workers. Lots of times the employer will create new companies to make sure that they can remain under the reporting requirements.
2. Pay wages in cash and don't withhold.
Both of these common methods of hiring undocumented workers are illegal.

Under 8 U.S.C. §1324a(f), any person or entity that engages in a pattern or practice of hiring or employing undocumented aliens can be fined up to $3000 for each unauthorized worker, imprisoned for up to six months of the entire pattern or practice, or both.
"Texas"..."Lawmakers"..."Employers"..."Undocumented"..."Workers". That's what's going on all over the nation...even at Trump businesses.
I mean, I get the concept: Pay in cash and don't have a record of said employee(s). But to do that, you also can't really report the expense on your Income Statement, because you obviously can't produce a receipt for it.
So, either your business's profit margins are so high that you can afford to dramatically increase the personal wages that you claim for yourself by the amount of the cash paid to the hidden employees (therefore indirectly paying them out of your own pocket), or the portion of your total costs that these employees represent is such a small piece that it's immaterial and you tuck it in a larger C.O.G.S. line knowing that it won't be audited.....but if either were the case, then there wouldn't be any need to hire illegal labor to save money.
Or, I guess it's possible that the C.P.A. who audits your financial statements is a friend who turns a blind eye, which is always possible.
