The law is pretty clear that it only is relevant during a war
The Trumpies just say that we are at war - it's an invasion!
And they say - to quote directly - they do not care what the judges say.

FDR certainly challenged the limits of his "executive" power and thankfully was curtailed by the Courts.
Madison and Jay were brilliant in the Federalist papers to set up balancing of factions in the Constitution.
Much as I support many of the goals of the present administration I am so relieved that we have a judicial branch to restrict any excessive overreaches.
Now if only the Dems could shake off their emasculation complex we might reestablish the balance our Founders intended.
