they skipped a step to start with. they did not enter legally through a port and be processed as specified under existing laws. therefore, they are illegal and have no standing and can be deported without further legal action or interpretation.
nobody is opposed to immigration, but everybody (including - maybe especially - you, counsellor) should be strong proponents of legal entry for legitimate reasons.
not closed borders, but controlled borders. it's called "sovereignty". without it, there is no country.

if they are suspected of violating u.s. laws on any level, they should be processed through the legal system appropriately. the case cited in your article could be complicated.
one thing is not complicated: the guardian is not a legitimate news source but 100% pure leftist propaganda. it even brags about that when it begs for your money. it is highly likely that the guardian has misrepresented or is misreporting a high percentage of what it's presenting because it will never print anything contrary to its political agenda.
