Anyone remember when Amy Wax was pilloried and exiled on campus for stating that she couldn't recall a single black law student who graduated in the top-quarter of his/her class at Penn? Amusingly, UPenn's law school dean came out and categorically stated that there had been black students who graduated in the top-quarter, but provided no numbers. One would think if many had, he would have stated that "hundreds of black law school graduates here at Penn finished in the top quarter of their classes." It's safe to assume that the number was miniscule, which obviously limits how many can clerk for SCOTUS justices if they are judged solely based upon smarts and acumen, but the hypocrisy of someone like RBG picking only one while maintaining her stance on affirmative action smells to lowly hell.
