After finding that Trump engaged in fraud by flagrantly padding financial statements that went to lenders and insurers, Judge Arthur Engoron ordered him last year to pay $355 million in penalties. With interest, the sum has topped $515 million.

The total — combined with penalties levied on some other Trump Organization executives, including Trump’s sons Eric and Donald Jr. — now exceeds $527 million, with interest.

“While the injunctive relief ordered by the court is well crafted to curb defendants’ business culture, the court’s disgorgement order, which directs that defendants pay nearly half a billion dollars to the State of New York, is an excessive fine that violates the Eighth Amendment of the United States Constitution,” Judges Dianne T. Renwick and Peter H. Moulton wrote in one of several opinions shaping the appeals court’s ruling.

Bill Barr, having all references to DJT (i.e. "Individual-1") removed from charging documents against Michael Cohen in the case that sent him to prison for the Stormy Daniels payoff scheme...thus blocking SDNY from pursuing Trump for initiating the felony that benefitted him in the lead up to the 2016 election. Now that's what you call "Lawfare".

If you doubt this statement on my part, go to your library and take out a copy of Berman's book, "Holding The Line" and go to the chapter entitled "We Are Going To Lose Cohen"...it has names and quotes by attorneys who can backup what happened.

The ball is in your court now...show us EVIDENCE of 'Lawfare' by the Dems...

Since there wasn’t a majority reached in Thursday’s decision, the case can automatically qualify to be heard in the Empire State’s top court — the New York Court of Appeals.

I'll wage they find there was never any cause of action for the fraud claim under the Consumer Protection Statute.

It will take Trump one more step to win this. But this is a start. An excessive fine that violates the 8th Amendment is a pretty damning ruling.

You provided a false statement as a material fact

You knew the information was incorrect

You intended to deceive the victim

The victim relied on your false statement

They suffered damage as a result of relying on your knowingly false information

MOREOVER: The New York Court of Appeals is likely to rule that NY's Consumer Protection Statue was never intended to cover big boy real estate deals.

BUT,,, this case probably bolstered Trump's campaign. Letitia was hoisted on her own petard.

could not stand behind Trump's financial statements due to the poor information he gave them...and they'll likely be called again...in front of a jury...to repeat those details...should there be another trial.

IMO Trump should negotiate a lower penalty...but his off-the-charts Malignant Narcissism...and mentor, Roy Cohn's words ("NEVER Admit Defeat"...even if you're wrong), echo in his mind.

But first I’d like to point out how disappointing it is to know the many of on here claim law and order yet support a thief convict seeing his malfeasance as winning.

“A New York appeals court on Thursday threw out a half-billion dollar judgment against President Trump, eliminating the enormous financial penalty while declining to overturn the fraud case against him.

“While harm certainly occurred, it was not the cataclysmic harm that can justify a nearly half billion-dollar award to the state,” wrote Peter Moulton, one of the appeals judges whose lengthy and convoluted ruling reflected significant disagreement among the five-judge panel.

The president’s appeal will now most likely move to New York’s highest court, providing him another opportunity to challenge the finding that he was a fraudster.

Thursday’s ruling handed Mr. Trump a financial victory and represents a major setback for the New York attorney general, Letitia James, who is one of the president’s foremost adversaries. The case had been a career-defining victory after she campaigned for the attorney general’s office promising to bring Mr. Trump to justice.
However, the decision fell short of the legal vindication the president had been seeking in his fight against Ms. James. In denying Mr. Trump’s bid to throw out the case, the court kept in place the ruling that he had committed fraud, an ignominious distinction for a sitting American president.

Ms. James filed the case against Mr. Trump and his family real estate business in 2022, accusing them of inflating his net worth to obtain favorable loan terms. After a monthslong trial, the judge overseeing the case ruled last year that Mr. Trump was liable for fraud, denting the real estate mogul image that underpinned his political rise.

Thursday’s ruling came almost a year after judges heard oral arguments on the appeals case, an unusual delay that reflected the legal and political complexities of a case against a sitting president. The case infuriated Mr. Trump, who has sought revenge against Ms. James. His Justice Department has opened multiple cases into her and her office.”
