The pre-trial testimony of the deceased partner might be informative. "It's all my fault."
For example, conversations in days preceding, conversations while in vehicle, why partner said, "It's all my fault?" This was mentioned by a neighbor witness. Out of court yes, hearsay yes, exception yes, an excited utterance. Could be explained by partner being overcome with grief but that determination is for the trier of fact if judge lets it in. Pertains to intent. 18 U.S. Code Sec. 373c.
