Almost every State has a version of Federal 1983 civil statute, and criminal statutes to prosecute.

As a federal agent, defendant can remove civil suit or criminal prosecution to federal court.

Civil action has to overcome immunity hurdles.

If Minnesota seeks a criminal prosecution, they should wait until new Administration in power.

It seems to me it’s either a justifiable homicide or not, and any charges would stem from that under Federal law.

How about the right to walk down the street and help a woman in distress.

I know this is not “enumerated” in the Constitution but if we can read that document and find INFINITE executive power we can probably find this too.

The following constitutional rights were infringed:

1st - speech - he is allowed to protest peacefully

2nd - arms - he was legally carrying and law enforcement can not justify its behavior especially given that the weapon was not drawn or used illegally

4th - search and seizure - they had no right to apprehend and seize his weapon which was not being used illegally

8th - cruel and unusual punishment - shooting the man 10 times especially after his weapon was seized by ICE

10th - states rights - ICE is infringing on normal state protections.

Those civil penalties should also consider criminal penalties for voluntary man slaughter or possibly second degree murder. These “brown shirt” tactics should jail all of these SOBs.

for Doctors, Nurses, Staff and Patients at the Hospital where he worked in the ICU, in case a gunman overcame a Security Guard and took his gun (see my earlier post that details such an instance very recently). Word travels around the Medical Community about such things...it would make perfect sense for a very fit 37 yr old man...and Nurse...to want to protect others...ergo the concealed carry permit.

I'll also repeat what I said earlier...ICU Docs and Nurses have to be "On Call" many times at any time of the Day or Night, in case of Medical Emergencies...Therefore, it's reasonable for him to constantly carry that handgun with him virtually everywhere...everyday. I'll be talking with our family ICU Doc fairly soon and get that perspective on such a scenario.

btw, re: 2 'Mags' of Ammo...should Alex Pretti be the 'Last Resort' after a Security Guard is overwhelmed...he just might need an above average amount of ammunition.

When he engaged ICE, I’d say he forfeited all of those except 8

Engaging in your mind includes:

1. Using your camera to record their behavior
2. Walking backwards and then ICE putting their hand on you
3. After seeing a woman inappropriately and unprofessionally shoved standing in front of her to prevent further abuse
4. Being sprayed with mace

These ICE agents are inadequately trained. Shooting a man in the back who was by no means violent AFTER removing his legally carried weapon was unforgivable. They had six agents and were unable to control one person. They need to be fired and, then, arrested.
