Attached is New Mexico’s statute which seemingly imposes criminal liability based upon a negligence standard. I would have to read caselaw as to what exactly is “without due caution or circumspection.”
Who handed Baldwin the firearm prior to filming the scene? Do they use live bullets in production? What steps are taken to separate prop firearms/ammo from live firearms/ammo?
Was it reasonable for Baldwin to assume the firearm did not contain live ammo? What steps, if any, did Baldwin take to ensure the firearm did not contain live ammo?
