The President can name any senior Justice Department official as long as that person has served in a high level position for at least 90 days.
The person appointed as acting AG can not then be nominated to be Attorney General, so Whitaker will be replaced as soon as Trump nominates a permanent AG and that person is confirmed by the Senate.
Just sayin not the first time a person has been put in that job specifically to do the bidding of the prez and have his back.

Only two things come to mind-so far.
First, When he was the prosecutor for the southern district in Iowa he went after a rising politician who happened to be gay and a democrat. He had someone wear a wire and tried to build a bribery case against the guy-Matt McCoy. He tried hard to get McCoy but a jury in red state Iowa was out 90 minutes a found McCoy not guilty.
Whitaker often spoke of allowing God to guide him and made similar evangelical statements. I'm sure the fact that McCoy was gay was a coincidence.
I believe Whitaker is currently being looked at by investigators for his role as a paid advisor to a company that scammed customers out of 29 million. This is in Wall Street Journal.
I more concerned about sky pilots and their being guided by God when they use their powers as prosecutors.
