They already have the power to use the EPA to write virtually any regulation they feel they can get away with politically.
I get where you are coming from, but there are only two outcomes:
1) POTUS is stopped. That sets very good precedent. I'd be fine with them stopping Trump as long as the precedent is clear.
2) POTUS is not stopped from doing this, in which case the Dems would do the climate change emergency anyway, and why not get some conservative emergencies declared now?
Granted, the Dems could take the long view, and let Trump build the wall under emergency powers, in anticipation of getting their way on something they really care about. But, I don't think they think that way with Trump. They must oppose him, no matter what he does.
