particular one (Comey's leaking memos). The reason is that Comey indeed made an effort trying not putting classified info in memos. So it's hard for DOJ to say Comey intended to leak classified information. So, even DOJ indict him, probably they will lose the case. I feel this is the case that if you charge him, it will be overcharge; if you don't charge him it will be undercharge. But since he already got fired, i.e. got punished. I think not charging him is probably a correct call.

Comey was informed. It turns out that Comey kept copies illegally in his safe for 2 years thereafter until investigated, and he never informed the IC about the copies he had which is mandated by law at the point that he was informed that they are classified.
But in a technical sense, since these obviously classified documents were created by him secretly, they had no opportunity to officially be classified yet at the time he leaked them.
