Nearly 85% of NBA players are black while most of those who attend and watch games are white. So taking notice of the ruling against Asian Americans, Harvard is fine trying to level the playing field. Talent doesn’t matter as much as diversity. So I want more white, Hispanic, and Asian players in the NBA that represents America’s diversity. If we can’t have 70% Asian Americans in the science and math classes at Harvard an institution that takes federal dollars, then why do we have 85% black players in the NBA? It’s not about talent it’s diversity that counts in America. Hopefully we will get the same judge that ruled against the Asian Americans. Let’s see her worm her way out of this one.
Title VII of the Civil Rights Act applies to employment. The Uniform Guidelines on Employee Selection Procedures (UGESP) would apply to the hiring process for NBA players.
The disparate impact you describe is legal as long as the selection procedures are “job related and consistent with business necessity.”
From my perspective, the NBA probably does a better job than most US companies with their unstructured interviews in meeting this standard.
