The judge: "[T]hings happen and documents are lost. I mean, it just happens." The document that is the basis for the prosecution is lost. No biggie.
Flynn knew it was missing and plead guilty anyway. He told the same lie to Pence which would be hard to explain. He also knew they could have charged him as an unregistered foreign agent of Turkey which he also admitted in the plea.

The issue is whether the judge has to allow the dismissal because the govt NOW wants to dismiss the case even though there is already a guilty plea. Or, can the judge refuse to allow the plea to be withdrawn, and not allow the dismissal? In no way shape or form will the judge either convict or not convict him. You did go to law school, right? Have you ever practiced law?

I didn't know he was formally convicted. I thought the conviction was held in abeyance (or whatever criminal lawyers call that type of thing) pending the outcome of his cooperation. Perhaps it was just the sentencing. Whatever. I do think if he was already convicted, and he is just awaiting sentencing, that does change things a bit.
