Scalia wanted to keep the ocurt above politics, not Ginsburg. She was a political activist from the bench. Her passing does not change this fact. Just because Sotomoyer is even more the activist doesn't make Ginsburg a reasonable person.

And I proudly stand in opposition to killing of the unborn. Proudly, always. There are a lot of other reasons to avoid a liberal justice nomination (see Obamacare), but that will always necessitate first consideration given the gravity of the actions involved.

opposite of what a justice is supposed to be. If she uttered it, she had to know it would be made public. She'd only need to look at some of her colleagues to see examples of justices who do not and would never utter such things in front of others. It's the sort of comment that undermines public trust in the Court. Then again, I can't think of another institution that has gotten things wrong more often, in such monumental ways, than the U.S. Supreme Court over its history.
