The only thing that could stop it is Democratic control of one of the branches. Once the GOP has then all, then HR1 will be a national ban on abortion.
And Ned and Baron will forget their enthusiasm for states’ rights and hop on board, baby! Because “states’ rights” is always code word for reactionary policies. When they get in the way of reactionary policies, they can be easily jettisoned.
But, no, I highly doubt a national ban is coming. Isn't the basis of the as yet not delivered decision supposed to be that the Constitution wouldn't allow that?
Sophisticated people have two views on this:
1) Moral view: Of course I would be happy about a nationwide ban, because fewer people would be dying due to state sanctioned violence.
2) Constitutional view: States have the right to decide whether it is banned in their territory because this is not an issue over which the Constitution grants Congress power. So, if Democrats want to kill their young, they can decide to do so where they have a majority. That is unfortunate for the moral aspect, but that is Federalism. I don't get why New Yorkers are upset about Texas not wanting to kill their young. Why is that a huge issue for the New Yorkers? Why is abortion a sacrament for the Left, that they need national level compliance?
