Everything that I have read seems to point to her as the least intelligent. No idea where your nephew in law is coming from.
Yet climate idiocy induces all sorts of strange behaviors.
For example, a Supreme Court justice sounding like a teenage girl - ‘I can’t think of many things more frightening’. Really?

I'm no Kagan fan. But Justice Scalia told the story that he was talking to David Axelrod after Justice Souter announced his retirement that while he (Scalia) shared no illusion that Obama would nominate someone with a viewpoint similar to Scalia, he hoped he would send them someone smart. He then further said he meant Elena Kagan. He asked Axelrod to pass this on to President Obama.
If Antonin Scalia thought Kagan was smart, she is.
Obama, of course, ignored Scalia's advice and named Sotomayor to the high court. IMO, she is a candidate for the dumbest justice in modern history. Obama did then nominate Kagan to succeed Justice Stevens a year or toe later.
Her partisan political and personal views have seemed to drive some of her rulings, rather than what the law explicitly says and doesn't say.
Her statement on the EPA case was way over the top.
Of course, that usurps the legislative function.
Like the abortion case, this is the right legal decision. Jurists like Kagan and their contextualism are truly dangerous because their view of the law is akin to moral relativism.
I think Sotomayor is actually a bigger moron.
Why would we want to actually comply with a duly passed Constitution which formed our country?
The partisan does not understand the question. They assume others are like them...only using the constitution for political gain, and discarding it otherwise...like they do.
