The January 6th committee repressed any evidence that might have provided Trumo wth a defense.
The standard in a criminal case is "beyond a shadow of a doubt."
Garland sees both hurdles to a conviction and he does not want to fail.

It appears they have such evidence, but the professional prosecutors have to vet their case and feel highly confident they will obtain a conviction and that the conviction is appeal proof.

Once vetted there is almost zero chance of a conviction and NO WAY it doesn't get appealed if it did. The professionals in the DOJ will have to face a highly paid highly motivated equally talented defense team.
Best case scenario, in my opinion, the January 6 committee should take what they believe is the win in presenting their case to the public, without benefit of it being questioned, and call it a day. These hearings only emboldened Trump and his supporters. They're having the exact opposite effect. Those who hate trump already convicted him. Those who love him see this as more justification of a plot to get him.
The rest of us take the kids to practice, mow our lawns and try to have a healthy dinner ready.
Trump conspired to defraud the United States. The biggest obstacle is always criminal intent/state of mind.
The January 6th hearings have offered compelling evidence that Trump clearly knew his Big Lie nonsense was in fact a Big Lie. He took way too many steps thereafter to stop the certification of the electoral count (to include meddling in state counts in GA and AZ) and chose not to marshal resources to quell the mob storming the Capitol on January 6th. The DOJ will need 5-7 solid witnesses and co-conspirators -- who were in the loop. The DOJ will also unimpeachable corroboration to overcome defense attacks against those testifying witnesses.
It is an unprecedented fact pattern. Unprecedented occurrence.
We ought not underestimate Garland's tenacity and determination if, I say again if, the evidence to prove the conspiracy is jumping off the plate.
Evidence, that has yet to be refuted.
5 to 7 solid witnesses and co-conspirators.
Unimpeachable corroboration.
Proving criminal intent/state of mind?
And if one of the measurables is surviving appeal.
Not impossible, but offa! That's one helluva slog. And as Jar noted a few days ago, juries are a different animal altogether. So if you win, he's a martyr and more powerful than ever. If you lose he beat the system that done him dirty and he's more powerful than ever.
Aside from the criminal "stuff" I hope someone is keeping an eye on the political implications of all this. I think they are. I hope they are.
That is my point.
The flipside -- not charging despite compelling evidence -- means that a President can do whatever he/she pleases, without accountability or consequence.
The fact that the allegation is not murder or rape, does not change the calculus for the DOJ.
"Compelling" evidence is, in my opinion, a nebulous term and could be the ultimate bugaboo for the DOJ.

Trump is pretty famous for being a terrible client and screwing over his lawyers. That's why Rudy and that crazy woman were the only two who stuck around until the end.
The overarching point is Team Trump will get to put on a defense. Something he was not afforded previously. A conviction is no slam dunk. The cases will not be bullet proof and therefore subject to appeal. Garland is a lot of things, dumb ain't one.

In a quiet moment, you might realize that Trump did a helluva job vis-a-vis Russia and that this war, which you vehemently oppose with our tax dollars, just might be your fault, and the fault of other voters like you, who did not support Trump.
I doubt you will be able to reach that obviously correct conclusion, but one can hope.
I see Trump as the Dems greatest hope to retain the WH in 2024, which would be a catastrophe!
