Each P4 champion (plus highest ranked G5 champion) that is ranked in the Top 20 is an AQ,. The top 2 ranked conference champions (who played an actual conf championship game) get the coveted 1st round bye. However, they are not automatically the #1 & #2 seeds as the seeding order goes by the order of the final regular season ranking. The remaining spots after all AQs go to the highest ranked non-AQs who are seeded in order of final end of season ranking among all playoff teams.

This proposal is akin to the NFL awarding byes to the the winners of the NFC East and AFC West, every year.

You have (almost?) entirely public institutions chartered under state constitutions colluding to attempt to create a self-beneficial and exclusionary for-profit system within the confines of a tax-exempt education system, all without any Federal oversight and under the auspices of "it's education".
If they want to play the "it's education" card, then education is subject to regulation under Federal aid laws - cue the Federal government. If they don't, which is where I think this will land, then spin the whole thing into its own enterprise unrelated to education, recognizing that all profits should be fully taxable, and seek to obtain an anti-trust exemption.
Or ND may view as still a path to playoffs
