There are multiple examples of hardship/embarrassment/humiliation that are now being brought forth- for example one swimmer describes her experience of having to change into her suit in the broom closet.
To be clear for those ready to pile on the NCAA for its' stupidity (true), there are many corporations and schools that have enacted the exact same policies without considering the consequences to others as well.
The push back is going to further cripple the NCAA.
We need a gatekeeper to enforce rules in college athletics, but it sure can't be this feckless organization.
Gender and sex are not the same thing, and Title IX specifically addresses discrimination on the basis of sex. I'm sure those with an agenda intentionally conflate the two.
Those born men should either be in an open division or a former men only division. They should not compete against women regardless of whether they have transitioned or not or are on hormone replacement.
That was a Tittle VII case and not a Title IX case, but I expect the result would be the same--just different parts of the same statute.
In the employment context the only reasonable alternative is unemployment.
In the education context, the reasonable alternative is to compete in your birth sex, so arguably there is no “discrimination” against that group and there is instead against biological women.
It will depend on which “right” prevails, but extending the “sex” protection to gender identity for all purposes was overreaching.
