I’d argue it as simple breach of contract.

This suit would not be against any other University or Conference...just the "Bad Actors" in and around the Selection Committee that produced this travesty. Given all the impartial outrage I'm seeing, it wouldn't be hard to impanel a jury that would find in ND's favor.

Yes, this seems so unfair when you only look at it on an individual basis. Ie ND and Tosu both went to NC and both directly earned the same amount.
ND keeps all of theirs, Tosu shares theirs with the conference. But tell the rest of the story. How much money was shared WITH Tosu by all the other B1G teams vs how much was shared with ND from anyone else.
Last season the B1G received payments for 9 CFP games (vs ND's 4) and 8 additional bowl games from non CFP participants. Let's see the real numbers there, of what the total share for ALL B1G teams was, even the ones who sat at home on the couch.
ND gets nothing for sitting at home.

Tide went 9-3 against FBS competition (Eastern Ill), Miami 9-2 (Bethune-Cookman), ND 10-2 (all FBS). The CFP chair actually said that Bama showed grit in holding off (5-7) Auburn at the end in a one score game while ND merely took care of business against (4-8) Stanford (by 29 pts - and 43 pts until garage time). Heads, SEC wins, tails, rest of college football loses.
