The primary difference under the old BCS formula is that Notre Dame would have been ranked ahead of No. 10 Alabama (9-3), whereas the CFP committee ranked Alabama ahead of the Irish.

It's not either or. Both ND and Miami belong in the CFP.
The biggest problem is the SEC getting 5 spots. 12 team playoff is fine if one conference
Doesn't get nearly half the spots. f you can't finish top 2, you should be eliminated. If you don't like it, don't join a conference.
