To paraphrase Inigo Montoya from the Princess Bride…
“You keep using those words (due process). I do not think they mean what you think they mean.”
U.S. immigration courts are administrative courts. They are separate from Article III federal courts in the judicial branch. These courts hear removal (deportation) cases and are staffed by immigration judges appointed by the Attorney General. Because they are administrative rather than constitutional courts, they do not have features like jury trials or Senate‑confirmed judges, but they are still required to follow Fifth Amendment due process protections for all persons in the U.S., including non‑citizens.
This means that non‑citizens facing deportation are entitled to notice of charges and hearings, a neutral decision‑maker, opportunity to present evidence and cross‑examine witnesses, access to legal representation (though not guaranteed in all cases), and reasoned decisions and the ability to appeal.
Illegal aliens are given administrative due process by the Trump Administration, but that’s not what leftists want. Democrats want Article III federal courts to take over immigration proceedings. They want to bog the process down and keep their illegal aliens in the country. It’s a continuation of Biden’s open-border policies and part of a cynical strategy to tilt Congressional apportionment to favor blue states and ultimately build another massive dependency class and Democrat voting bloc.
